Privacy Act Statements

The Privacy Act of 1974, as amended (Privacy Act), as implemented within the Department of Defense (DoD) by DoD 5400.11-R, applies to each system of records maintained by a DoD Component. A “system of records” is a group of records containing an individual’s personally identifiable information (PII) maintained by a DoD Component and from which the individual’s PII is retrieved by information unique to the individual. When information is being solicited and collected from an individual for a system of records by either paper or electronic means, the DoD Component collecting the information is required to provide and/or post a conspicuous and formal notice at or before the point of collection. That notice, called a Privacy Act Statement, provides the following information to individuals:

  • Authority: The Federal statutory authority, DoD regulatory authority or directive, and any additional applicable guidance, that authorizes the solicitation and collection of the PII sought by the DoD Component;

  • Purpose: The principal purpose for which the DoD Component intends to use the solicited and collected PII;

  • Routine Use: The routine disclosures of PII (referred to as "uses") which the DoD Component may make outside DoD, compatible with a purpose for which the PII was collected, as provided for by the Privacy Act and DoD 5400.11-R, and as stipulated in the respective system of records notice published in the Federal Register; and

  • Disclosure: Whether provision of the PII by an individual is mandatory or voluntary and the effects, if any, on the individual if he or she chooses not to provide all or any part of the requested PII.

Sample Privacy Act Statement

“On October 1, 2013, the Department of Defense established the Defense Health Agency (DHA) to manage the activities of the Military Health System. These activities include those previously managed by TRICARE Management Activity (TMA), which was disestablished on the same date. During the next several months, all TMA websites will change to reflect the new DHA. We appreciate your patience during this transition."
